1. Introduction
These Terms and Conditions ("Terms") govern your use of services provided by Telsense Technology Group ("Telsense," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
2. Service Description
Telsense provides fibre internet services to residential and business customers in South Africa. Our services are subject to availability in your area and are provided on the Openserve fibre infrastructure.
3. Account Registration
To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Service Activation and Installation
Upon ordering our services, we will schedule an installation appointment. Standard installation is included in the service fee, but additional charges may apply for non-standard installations. You must be present during the installation or designate an authorized representative.
5. Service Fees and Billing
You agree to pay all fees associated with your selected service plan. Fees are billed monthly in advance. Payment is due on the date specified in your invoice. We reserve the right to change our fees with 30 days' notice.
6. Term and Termination
Unless otherwise specified, our services are provided on a month-to-month basis. You may cancel your service at any time by providing written notice at least 30 days in advance. We may terminate or suspend your service for violation of these Terms or non-payment.
7. Equipment
We may provide equipment (such as a router) for your use during the service period. This equipment remains our property and must be returned upon termination of service. You are responsible for any damage to the equipment beyond normal wear and tear.
8. Acceptable Use
You agree to use our services in compliance with all applicable laws and our Acceptable Use Policy. Prohibited activities include, but are not limited to, unauthorized access to other networks or systems, distribution of malware, and excessive bandwidth usage that disrupts the network.
9. Service Availability and Quality
While we strive to provide reliable service, we do not guarantee uninterrupted or error-free service. Service quality may be affected by factors beyond our control, including third-party networks, equipment failures, and force majeure events.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with these Terms or the use of our services.
11. Indemnification
You agree to indemnify and hold harmless Telsense, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your use of our services or violation of these Terms.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website or via email. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
